Section 3
Prohibition on production and sale distribution of contaminated food or substandard food

No person shall produce, sell, distribute, export or import contaminated food or substandard food or keep such food for any of these purposes. 

4. Foodstuffs should not be sold and distributed under false pretences: Anyone misrepresenting any foodstuff as another foodstuff or misrepresenting a low-quality foodstuff as a high-quality foodstuff or mixing a low-quality foodstuff or a non-foodstuff with a non-edible foodstuff or a high-quality foodstuff. It should not be sold and distributed. 

4a. Foodstuffs can be stopped: (1) If there is any suspicion that any foodstuff is contaminated or of low quality, the designated officer can seal such foodstuff and entrust it to the owner of the foodstuff and take compensation for it. (2) After the final decision has been made that the foodstuff detained under sub-section (1) is contaminated or of inferior quality, the foodstuff can be seized by the Government of Nepal by the order of the designated authority after considering the amount of defect, the nature of the defect and the damage that may result from it. 

4b. Obtaining a license: (1) A person who wants to produce, sell, distribute, store or process specified food items must obtain a license in the prescribed manner. (2) Notwithstanding anything written in sub-section (1), in the case of sealed food items, the retailer who has obtained a bond as specified from the licensed manufacturer or wholesaler shall not obtain a license under this section. 
